Cancellation and Refund Policy
How subscription cancellation, renewal, refunds, plan changes, and account closure are handled by AXQA.
Effective date: September 5, 2026
Last updated: September 5, 2026
This Cancellation and Refund Policy explains how cancellations, renewals, refunds, credits, plan changes, and subscription termination are handled for AXQA services. It forms part of the AXQA Terms and Conditions.
AXQA is operated by AXQA TECHNOLOGY LTDA, CNPJ 68.755.091/0001-09, São Paulo, SP, Brazil. If an Order or separate written agreement signed by AXQA contains different cancellation or refund terms, that signed agreement or Order controls to the extent of the conflict.
1. Scope
This Policy applies to subscriptions and paid services purchased directly from AXQA unless a separate written agreement, Order, marketplace, reseller arrangement, or legally mandatory rule provides different terms.
2. Billing Cycles and Subscription Terms
AXQA may offer monthly, quarterly, semiannual, annual, or other billing cycles, as well as custom enterprise or committed-term arrangements. The applicable plan, price, billing interval, currency, usage limits, and term are shown during purchase or in the applicable Order.
3. Automatic Renewal
Unless an Order expressly states otherwise, recurring subscriptions automatically renew for the same billing interval at the end of each billing period until cancelled. The Customer authorizes AXQA and its payment providers to process recurring charges using the payment method associated with the subscription.
The Customer is responsible for cancelling before the next renewal if it does not want the subscription to renew. A cancellation submitted after a renewal has already been processed generally applies to the following renewal, subject to applicable law and any written agreement.
4. How to Cancel
A Customer may cancel a recurring subscription through the account or billing interface when that functionality is available, or by sending an authenticated cancellation request to [email protected].
A support request should identify the Customer organization or workspace and the subscription to be cancelled. AXQA may request reasonable verification that the requester is an authorized account or billing administrator before processing the cancellation. Verification will not be used to improperly prevent a cancellation right required by applicable law.
A cancellation made through the platform is recorded when the platform confirms the action. A cancellation requested through support is effective when AXQA confirms the authenticated request in writing, except where applicable law requires a different effective time.
5. Effect of Cancellation
Unless an Order, written agreement, or applicable law provides otherwise, cancelling a subscription stops future automatic renewal but does not retroactively cancel the current paid billing period. The Customer may normally continue using the paid service until the end of the already-paid period, subject to these Terms, plan limits, security restrictions, and any outstanding obligations.
6. No Prorated Refunds by Default
Except where required by applicable law or expressly agreed in writing, AXQA does not provide prorated refunds or credits for unused days, unused features, unused projects, unused Users, remaining storage, unused automation runs, unused Smart Actions, or other unused capacity within a paid billing period.
7. Prepaid Quarterly, Semiannual, Annual, or Committed Terms
Prepaid multi-month or committed-term subscriptions are priced in consideration of the selected commitment. Except where required by applicable law or expressly stated in the applicable Order, cancelling before the end of a prepaid or committed term does not create a right to a refund of the unused portion and does not eliminate amounts contractually committed or already due.
Cancellation of automatic renewal for such a subscription means that the subscription will not renew after the current prepaid or committed term ends.
8. Monthly Subscriptions
For a monthly subscription, cancellation generally prevents the next monthly renewal. The current month remains paid and available through the end of the billing period unless the service is terminated earlier for breach, security reasons, non-payment, or another reason permitted by the Terms and Conditions or applicable law.
9. Plan Upgrades
When a Customer upgrades a plan, the effective date, immediate charge, prorated amount, credit, or next-invoice treatment will be the amount and timing displayed in the platform or stated in the applicable Order. An upgrade does not by itself create a right to refund previously paid amounts.
10. Plan Downgrades
Unless the platform or an Order expressly states otherwise, a downgrade may take effect at the next renewal or billing period. The Customer is responsible for reviewing whether the lower plan has sufficient project, User, automation, Smart Action, feature, or storage limits before the downgrade becomes effective.
AXQA may require the Customer to reduce usage, archive or export data, remove Users, or otherwise bring the account within the new plan's limits. AXQA is not responsible for loss of access to features or capacity caused by a Customer-requested downgrade when the effect of the downgrade was disclosed.
11. Trials and Evaluation Access
A trial or evaluation may be cancelled at any time before it converts to a paid subscription if the trial terms provide for automatic conversion. If payment information is required for a trial, the Customer is responsible for cancelling before the stated conversion or renewal date if it does not want to be charged.
AXQA may modify or end free trials, demonstrations, previews, or evaluation access according to the trial terms and the AXQA Terms and Conditions.
12. Refunds Required by Law
Nothing in this Policy limits refund, withdrawal, cancellation, or consumer rights that cannot legally be waived.
If and only to the extent a transaction qualifies as a consumer relationship subject to the Brazilian Consumer Defense Code and its statutory right of withdrawal applies to the online contracting of the service, the eligible consumer may exercise that statutory right within the legally applicable seven-day period counted as provided by law. When that statutory right applies, AXQA will process the cancellation and refund as required by applicable law.
The existence or scope of consumer rights may depend on the nature of the Customer, the purpose of the purchase, the contracting method, and applicable law. AXQA's primary business offering is a professional SaaS service, and not every business transaction is necessarily a consumer transaction.
13. Duplicate or Incorrect Charges
If you believe AXQA processed a duplicate, incorrect, or unauthorized charge, contact [email protected] promptly with enough information to identify the transaction. AXQA may investigate the billing records, payment-provider information, account activity, and subscription status before determining the appropriate correction.
If AXQA confirms a billing error attributable to AXQA, AXQA will correct the error through an appropriate refund, credit, invoice correction, or other lawful method.
14. Service Failure and Refund Requests
A temporary outage, maintenance event, isolated defect, third-party failure, Customer-environment problem, network restriction, unsupported configuration, or issue outside AXQA's reasonable control does not automatically create a right to a refund.
If a signed service-level agreement or Order provides a specific service credit or remedy, that remedy applies according to its terms. Any mandatory legal remedy remains unaffected.
15. Suspension or Termination for Customer Breach
If AXQA suspends or terminates access because of material breach, unlawful activity, fraud, abuse, unauthorized testing, serious security risk, repeated violation of the Terms, or non-payment, fees already paid are not refundable except where applicable law requires otherwise.
Suspension or termination for breach does not eliminate amounts already due or other obligations that survive termination.
16. Termination by AXQA Without Customer Breach
If AXQA permanently discontinues a paid service during an already-paid term for AXQA's own business reasons and does not provide a reasonably comparable replacement or continuation, AXQA may provide a prorated refund or credit for the unused prepaid portion, unless a different remedy is stated in a signed agreement or applicable law requires another result.
17. Payment Processor, Bank, and Currency Effects
Refunds are normally issued through the original payment method or another lawful method selected by AXQA when necessary. Processing time after AXQA issues a refund may depend on the payment provider, card network, bank, country, or financial institution and may be outside AXQA's control.
Exchange-rate differences, foreign-transaction fees, bank fees, card-network charges, or other third-party costs may not be controlled by AXQA. AXQA is not responsible for such third-party costs except where applicable law requires otherwise.
18. Taxes
Refund treatment for taxes depends on applicable tax law, invoice rules, the transaction, and the ability to reverse or adjust the corresponding tax document. AXQA will handle tax adjustments required by applicable law.
19. Chargebacks and Payment Disputes
Customers should contact AXQA promptly regarding suspected billing errors so AXQA can investigate. A chargeback does not automatically cancel a subscription or eliminate a valid contractual payment obligation.
AXQA may suspend affected billing or account access while a payment dispute is investigated and may provide relevant transaction, subscription, and account records to the payment provider as reasonably necessary to respond to the dispute, subject to applicable law.
20. Cancellation Is Not the Same as Account or Data Deletion
Cancelling renewal does not automatically delete the Customer's account or Customer Data. Unless the service is otherwise terminated, the Customer may retain access through the end of the paid period.
After access ends, Customer Data may be retained or deleted according to the AXQA Terms and Conditions, Privacy Policy, applicable Order, backup cycles, legal requirements, security needs, and technical limitations. Customers should export data they wish to retain before access ends.
21. Outstanding Amounts
Cancellation does not waive invoices, committed fees, taxes, overages, or other amounts already due under the applicable subscription or Order. AXQA may pursue lawful collection of undisputed overdue amounts.
22. Custom, Enterprise, and Negotiated Agreements
Enterprise Customers or Customers with negotiated commercial terms may have minimum commitments, notice periods, renewal windows, non-cancellable terms, service credits, custom refund rules, or other provisions different from this Policy. The signed written agreement or applicable Order controls where it expressly differs from this Policy.
23. Promotions, Discounts, and Credits
Promotional pricing, coupons, discounts, account credits, free months, or other commercial benefits may be subject to separate conditions. Unless expressly stated otherwise, promotional value and non-cash credits are not redeemable for cash and are not refundable after cancellation.
24. Changes to This Policy
AXQA may update this Cancellation and Refund Policy from time to time to reflect changes in plans, billing methods, payment providers, service operations, legal requirements, or business practices. Unless applicable law or a signed written agreement requires otherwise, the updated Policy becomes effective when posted on the AXQA website or on the effective date stated in the updated version.
AXQA is not required to provide individual notice of routine, administrative, clarifying, non-material, or legally required changes where individual notice is not required by law. Material changes will be handled consistently with applicable law and any controlling written agreement.
